Collection and Processing of Personal Data

Personal data is any information related to a person: name, email, address, phone number, ID/NIE… Additionally, when a User visits our website, certain technical information is automatically stored, such as the IP address assigned by their internet service provider.

AVERTICA®, as Data Controller, must inform Users of its website about the collection of personal data that may take place either by email or by filling in forms on the website.

Only the data necessary to carry out the contracted service or to respond properly to the User’s request for information will be collected. The data collected is identifying and represents a reasonable minimum to carry out the activity. Particularly, no specially protected data is collected at any time. Data will never be used for purposes other than those for which it was collected.

Contact Forms / Email

  • Purpose: To respond to your request for information made through our contact form(s).

  • Legal Basis: The legal basis is the User’s consent, which can be withdrawn at any time.

  • Data Transfer: Personal data will be processed via servers managed by Raiola, who will act as Data Processor.

Newsletter Subscription Forms

  • Purpose: To send communications, some of them commercial, of interest to the User according to the blog’s topic. As established by the LSSICE, AVERTICA® undertakes not to send commercial communications without identifying them as such. Communications sent to maintain an existing contractual relationship are not considered commercial communications.

  • Legal Basis: The User’s consent, which can be withdrawn at any time.

  • Data Transfer: Data will be processed by servers managed by Mailchimp, acting as Data Processor.

User Registration / Client Onboarding / Contracting Forms

  • Purpose:

    • Manage your user registration on our website.

    • Manage contracted services.

    • Provide information about order processing and status.

    • Maintain a record of contracted services.

    • Send communications by email and/or phone regarding possible incidents, errors, problems, and order status.

  • Legal Basis: Execution of a contract.

  • Data Transfer: AVERTICA® will not disclose your data to third parties, except when legally required or necessary for service provision. Data may be shared with:

    • Technology service providers.

    • Payment service providers.

    • Courier services.

    • Third parties acting on our behalf (accounting, legal services…).

In these cases, data transfers will observe strict confidentiality, using measures such as confidentiality agreements or adherence to their privacy policies. Users may oppose the transfer of data to Processors through a written request.

In certain cases, customer data may be transferred to public authorities to comply with legal obligations: Spanish Tax Agency, banks, Labor Inspection, etc.

Minors

Only individuals over 14 years old may provide personal data on this website. For minors under 14, parental or guardian consent is required.

Only individuals over 18 may contract our services. If under 18, legal guardian consent is mandatory unless the minor is emancipated.

User Registration – Passwords

User registration occurs automatically upon the first purchase. The user must fill in the purchase and registration form and make payment. The form collects:

  • Company name (if applicable)

  • Email and/or phone number

  • Address

  • ID/VAT

  • IP address

The User must accept the Terms and Conditions displayed elsewhere on the website. After completing the purchase and registration, the User receives access credentials by email. Passwords do not expire. To reset the password, the User must use the specific recovery form. The User is responsible for maintaining the confidentiality of their password and for all activities under it. Any unauthorized use must be reported to AVERTICA® as soon as possible.

Upon registration, the User gains access to a private panel to view exclusive content, access courses, order history, support, etc. Account options can also be managed.

The User may receive the following notifications:

  • Upon registration (account validation email).

  • For order management (invoices, issues, renewals…).

  • Newsletter (if subscribed; can unsubscribe anytime).

  • Password recovery.

  • Account cancellation.

Security Measures

Users are informed that AVERTICA® has adopted all security measures within our reach to prevent loss, misuse, alteration, unauthorized access, or theft of data, ensuring confidentiality, integrity, and quality in accordance with data protection laws. The website uses SSL encryption for secure data submission.

Data Accuracy

The User declares all provided data is true and undertakes to keep it updated. The User is responsible for the accuracy of their data and any conflicts or disputes arising from incorrect information.

  • Clients: data retained until the contractual relationship ends.

  • Newsletter subscribers: data kept until consent is withdrawn.

  • 6 years: Commercial Code

  • 10 years: Anti-Money Laundering Law

  • Indefinitely: anonymized data

Social Media

AVERTICA® has profiles on major social networks (Facebook, Instagram, YouTube) for informing users and offering personalized support. Use of social networks is governed by their own terms and privacy policies, which we recommend reviewing before use.

AVERTICA® does not extract data from these platforms unless explicitly authorized by the User and is not responsible for their data handling practices.

Confidentiality

All information provided by the User will be treated as confidential and will not be used for any purpose other than those described here. AVERTICA® agrees not to disclose User intentions, request motivations, or relationship details.

Validity

This privacy and data protection policy was drafted on February 17, 2025. It may change due to legal or jurisprudential updates. It is the User’s responsibility to review the updated document to understand their rights and obligations at all times.
