Purpose of the Website

The Avertica website serves the following purposes:

  • Providing Users with information about the services offered by the party responsible, as well as about the party responsible itself. Specifically, we offer access to a virtual academy for learning soft skills such as leadership, persuasion, and personal growth, among others, which through online courses teach our students to develop their full potential.
  • Disseminating information related to the party responsible’s field of activity.
  • Managing our internal referral program so that others may recommend us.

Legal Framework

The activity of this website is subject to the Spanish and European legal framework, specifically the following regulations:

  • General Data Protection Regulation (GDPR) (EU) 2016/679, of April 27, which governs the processing of personal data in the countries of the European Union.
  • Organic Law 3/2018, of December 5, on the Protection of Personal Data and the Guarantee of Digital Rights (LOPDGDD), a national regulation (applicable in Spain) that defines and expands upon many of the concepts and rights set out in the GDPR.

Any person accessing this website assumes the role of User, undertaking to strictly observe and comply with the terms set out herein, as well as any other applicable legal provision. “Avertica” shall not be liable for any damages, whether to itself or to third parties, caused by the improper use of this website by the User.

The content supplied by the Users of the website (personal data, images, etc.) is the sole and exclusive responsibility of those Users. “Avertica” undertakes to respect their privacy and anonymity, except where, at the request of an Authority, their data is required from us. “Avertica” will therefore not verify the information published, but it does have the right (though not the obligation) to investigate its content, for the purpose of complying with the law and with these Terms of Use.

The following conduct is strictly prohibited by “Avertica.” If the User commits any of the acts described in the points below that also constitutes a crime, “Avertica” reserves the right to report it to the authorities where such an act is confirmed:

Nevertheless, and in compliance with the provisions of Articles 11 and 16 of the LSSICE, “Avertica” makes itself available to all Users, authorities, and security forces, actively cooperating in the removal or, where applicable, blocking of all content that may affect or contravene national or international law, the rights of third parties, or morality and public order. Should a User consider that there is content on the website that may fall into this category, they are kindly requested to notify our staff immediately.

“Avertica” reserves the right to deny or withdraw access to the website without prior warning, on its own initiative or at the request of a third party, to those Users who breach our Terms of Use.

Intellectual Property

The website, including but not limited to its programming, editing, compilation, and other elements necessary for its operation, as well as its designs, logos, text, and/or graphics, are the property of “Avertica” or, where applicable, it holds a license or express authorization from the authors.

All content on the website is duly protected by intellectual and industrial property regulations, as well as registered in the corresponding public registries, and the reproduction and/or publication, in whole or in part, of the website is not permitted, nor is its computerized processing, distribution, dissemination, modification, or transformation, without the prior written permission of the same. “Avertica” will ensure compliance with the above conditions, as well as the proper use of the content presented on its web pages, pursuing all civil and criminal actions available to it in the event of infringement or breach of these rights by the User.

In any case, “Avertica” states that it will immediately remove any content that may contravene national or international law, morality, or public order, proceeding to immediately remove the redirection to that website and reporting the content in question to the competent authorities.

Applicable Law and Jurisdiction

The language in which this legal notice is drafted and interpreted is Spanish. This English text is provided as a courtesy translation; in the event of any discrepancy, the Spanish version shall prevail.

The relationship between “Avertica” and the User shall be governed in each and every one of its aspects by Spanish law, to which both parties expressly submit in the event of any dispute or matter relating to this website or the activities carried out on it.

Furthermore, in the event that the user is domiciled outside of Spain, “Avertica” and the User submit, with express waiver of any other jurisdiction, to the competent Courts and Tribunals of Spain.
